By way of a Regulation, the EU-Commission wants to facilitate the free flow of non-personal data and improve competition between cloud providers and other data-processing services in the EU.

Status

cep generally welcomes the ban on national data localisation requirements. Not introducing a statutory right to “data portability”, i.e. the right to have non-personal data transferred to the new provider when switching providers, is appropriate. However, in cep’s view, it is disproportionate that Member States are only permitted to retain data localisation requirements on grounds of national security.
