The EU Commission wants to introduce transparency obligations for online platforms and search engines EU-wide, as well as possibilities for redress for online traders using such online platforms. The EU Commission wants to regulate this by way of a Regulation.

Status

The planned transparency obligations for General Terms and Conditions would inter alia enable traders to better assess their ranking and competing offers from platform operators. The right of representative organisations to bring proceedings against platform operators before national courts also ensures that redress is possible in the EU even if an operator specifies a jurisdiction outside the EU. In cep’s view, however, case-by-case examination of whether a platform is exploiting user dependence should continue to apply rather than the introduction of blanket transparency and redress obligations.
