Transparent and Predictable Working Conditions (Directive)

By way of a new Directive, the EU Commission wants to promote transparent and predictable working conditions for workers. At the same time, the Directive should ensure the adaptability of the labour market. Affected are employers and employees, particularly those in non-standard employment relationships.

In cep’s view, the proposed extension of the employer’s obligation to provide information, and making it apply earlier, increases transparency and improves legal certainty for workers. However, the scope of the employer’s obligation to provide information is partly disproportionate. In addition, the Commission’s statement on subsidiarity, to the effect that diverging labour and social standards are detrimental to the internal market, is unconvincing in economic terms.
