“New Deal” for Consumers – Part 2: EU Consumer Law (Directive)

In view of increasing EU-wide violations, the EU-Commission wants to strengthen the enforcement of, and thus improve compliance with, EU consumer protection law. In the context of its “New Deal for Consumers”, it has submitted a corresponding Directive.

In cep’s view, the EU-Commission’s proposal strengthens the enforcement of consumer protection and brings it into line with modern business practices. In addition, the Directive improves transparency in online marketplaces and thus facilitates more rational buying decisions. However, express regulation is required regarding the extent to which Member States are permitted to continue to limit enforcement of consumer protection law to private law proceedings and consequences. In addition, the Directive must be brought more into line with the GDPR and the planned Directive on digital content.
