Harmonising Radio Spectrum Licences (Directive)

The EU Commission wants to further harmonise the rules on the use of radio spectrum. In cep’s view, the long minimum duration of 25 years for time-limited harmonised radio spectrum licences, envisaged by the Commission, should be abolished because, in the technologically fast moving telecommunications sector, it may result in the inefficient distribution of licences.

In view of the EU-Commission’s vague power to adopt implementing measures on the “modalities of application” relating to radio spectrum licences, there is a danger that these requirements will subsequently be harmonised by the Commission. In cep’s view, this is counterproductive. Competition-based requirements, on the other hand, may be necessary. The national regulatory authorities should, however, have to provide a market definition and analysis in this regard.
