Does TTIP need investment protection provisions?

The negotiations between the EU and the US on the free trade agreement TTIP are a hot topic at the moment. Investment protection in particular is the subject of heated debate. The cep takes a closer look at what kind of investment protection is really needed.

The cep believes that TTIP should not contain protection against expropriation without compensation. Laying down national treatment and most favoured nation treatment is sufficient. Moreover, arbitral tribunals as a means of enforcing investment protection should be rejected. A genuine judicial settlement of investment disputes by an international court should be advocated.
