The largely written procedure is much more susceptible to errors than proceedings where oral hearings are standard. Where the claim value may amount to 10,000 euro, the error rate is unacceptable. The limit on court fees reduces reluctance to bring legal actions and thus encourages the enforcement of rights. The EU has no power to extend the European procedure by redefining cross-border claims to include in effect domestic cases.
The EU patent facilitates the free movement of goods, services and investments. The limitation of translation requirements for EU patents leads to cost savings as the EU patent becomes much cheaper than the European patent. The European and EU Patents Court contributes considerably to legal certainty. Moreover, it lowers the law enforcement costs for both the European and the EU patent significantly. Legally critical aspects of the Draft Agreement on a European and Community Patents Court can be corrected selectively in order to ensure the Agreement’s consistency with EU law.

The Commission is trying to achieve a balance between protecting the interests of potential claimants and the need for both companies and society as a whole to prevent abusive litigation. However, the option for Member States to use the opt-out principle for reasons of “sound administration of justice” gives rise to legal uncertainty. The recommended binding effect upon the courts of decisions by authorities results in a curtailment of the legal process if affected parties can’t take action against the decisions of authorities.

Yes, Trump's election campaign was populist in the extreme, but he is certainly no fool. The very fact that he is not a professional politician means that he will be surrounded by advisors to keep him from acts of folly. Nevertheless, the consequences
